Police say charges are likely against driver in Rockland head-on crash

ROCKLAND — Police say the driver of a car that caused a three-vehicle crash on Aug. 27, including a head-on one on Route 1 in Rockland, is likely to be charged.

Tanna Halvorsen, 34, of Littleton, New Hampshire, was taken by ambulance to Pen Bay Medical Center in Rockport and then flown by a LifeFlight helicopter to Maine Medical Center in Portland, according to Rockland Police Sgt. Andrew Redden.

Halvorsen was listed Tuesday, Aug. 28, in stable condition, according to the sergeant.

Police had received a report shortly before the crash of an erratic vehicle, according to the officer. Halvorsen was driving north on Route 1 in a four-door Volkswagen sedan and stopped in the middle of Route 1 at the intersection of Pleasant Street.

A Chevrolet pickup truck driven by Jason Bailey, 43, of Warren attempted a left turn from Pleasant Street onto Route 1 to head toward Thomaston.

As he drove onto Route 1, Halvorsen accelerated from a stop and struck the pickup truck on its side.

She then continued driving north on Route 1 until she collided head-on with a small sports utility vehicle occupied by Ruth Woodward, 50, and James Woodward, 49, of Vermont.

Ruth Woodward and Bailey were taken to PBMC by ambulance with non-life-threatening injuries, according to police.

Both vehicles in the head-on crash were destroyed.

Route 1 was closed at the site – by the entrances to E.L. Spear and the Salvation Army – for about an hour following the crash, which occurred shortly after 3:30 p.m.

Thomaston police and emergency medical services, as well as North East Mobile Health Services, responded along with Rockland police and emergency medical services.

Crews also placed absorbent material on the road by the head-on crash to collect fuel and vehicle fluids that covered the road.

Redden said the case remains under investigation, but charges are likely against Halvorsen.

Wiscasset woman accused of killing girl seeks to have statements to police thrown out

A Wiscasset woman charged with murdering a 4-year-old girl in her care is asking a judge to throw out statements she made to law enforcement.

Shawna Gatto, 43, will appear in court Thursday morning in Rockland for a hearing on motions by her attorney. She has pleaded not guilty to depraved indifference murder. That charge alleges that whether or not she intended to cause the child’s death, she acted with depraved indifference to the value of human life.

Kendall Chick died from blunt force trauma to the abdomen, and also had suffered from prior abuse and neglect, police say. Her death Dec. 8 was one of two in Maine last winter that were blamed on child abuse, prompting an investigation by the Legislature and calls to overhaul the state’s child protection system. The case comes amid a startling increase in confirmed cases of physical abuse of Maine children – 52 percent from 2008 to 2016.

The Maine Department of Health and Human Services had placed Kendall with Stephen Hood, her paternal grandfather, and Gatto, his fiancée, in January. Gatto told police she had been caring for the little girl the day she was found unresponsive in a bathtub, and police said they found bloodstains in multiple places in the home. Gatto has been in jail since she was charged in December.

Jeremy Pratt, who represents Gatto along with attorney Philip Cohen, filed a motion last month to suppress all statements she made to law enforcement after Dec. 10, arguing that she had already requested an attorney and was not properly informed of her Miranda rights at the time.

The motion does not cite specific comments by Gatto, and a spokeswoman for the Maine Attorney General’s Office said they are not part of the public record. But an arrest affidavit includes comments she made during the 911 call and her initial description of events to police.

“Shawna Gatto indicated she put Kendall Chick in the bathtub and she was fine, she went to get Kendall Chick chocolate milk a few feet away in the kitchen and returned to find Kendall Chick unresponsive in the tub,” the affidavit reads.

The detective who wrote the affidavit then said Gatto’s version of events did not match the physical evidence found in the home or the autopsy findings.

Gatto’s attorneys also filed a motion related to the state’s chief medical examiner, Mark Flomenbaum, who performed the autopsy on Kendall. Gatto’s attorneys are asking the judge to allow them to introduce information at trial about Flomenbaum’s firing from the same job in Massachusetts in 2007.

The Maine Supreme Judicial Court denied an appeal this year on behalf of a convicted murderer, Keith Coleman, who said he should have been able to question Flomenbaum on the same issue at trial.

“Although we conclude that the court abused its discretion by foreclosing Coleman’s cross-examination of the chief medical examiner concerning his termination from his position as chief medical examiner in Massachusetts, the error was harmless in the face of the overwhelming evidence of Coleman’s guilt,” the majority opinion stated.

The hearing Thursday will begin at 9 a.m. at the Knox County courthouse.

Police beat suspect before he allegedly confessed to killing Cpl. Eugene Cole, lawyers say

The lawyers for the man accused of killing a Somerset County sheriff’s deputy have asked a judge to throw out his alleged confession, arguing that he had been beaten by the arresting officers and feared further physical violence if he didn’t cooperate with the state police detectives who interrogated him.

Verne E. Paradie Jr., a Lewiston-based attorney, said he filed a motion in Cumberland County Superior Court on Aug. 23 to suppress “any and all statements” that his client, 29-year-old John D. Williams of Madison, made to the detectives.

Maine State Police said John D. Williams was uncooperative so they had to hold him in place for this photo during his arrest April 28. Defense attorneys plan to use the capture photo as evidence in their suppression hearing.

Paradie contends that the statements were obtained illegally because his client was beaten by arresting officers and when state police homicide detectives arrived to interrogate him he feared “he would continue to be beaten by overzealous police officers.” Paradie’s court filing states that a confession is only admissible if it was given “knowingly, understandably and voluntarily, and the state has the burden to prove voluntariness beyond a reasonable doubt.”

“Obtaining confessions by physical abuse constitutes an egregious violation of an underlying principle of our criminal justice system … that ours is an accusatorial and not an inquisitorial system,” the motion states.

Williams has been charged with murder in the slaying of Cpl. Eugene Cole in April. Cole, 61, became the first Maine police officer fatally shot in the line of duty in three decades. Williams pleaded not guilty to the murder charge in June

In their motion, Paradie and co-counsel Patrick Nickerson say that “despite zero resistance by Mr. Williams, officers beat and pummeled him to the point of causing him to defecate himself. Photos show that the officers severely injured Mr. Williams, kicking him in the head and face, among other things, and causing severe bruising and then holding up his head by the back of his hair like a game trophy.”

The seven-man capture team included game wardens, state police, Fairfield police and FBI agents.

Court documents state that “When the interrogating detectives told him they were there to help him, naked, dirty, hungry, tired, beaten and in the throes of an opioid withdrawal, Mr. Williams sincerely believed they could help him get away from the beatings and was ready to tell them anything they wanted to hear to avoid further beatings.”

In the filing, Williams’ attorneys say that their client was in the throes of an opioid withdrawal when officers arrested him.

“Individuals in such a situation are not capable of advocating for themselves or making important decisions due to the withdrawal and their uncomfortable physical condition,” the motion said.

In a telephone interview Thursday night, Paradie said the publicity generated by the high-profile slaying caused the trial to be moved from the Skowhegan courts to Portland where Williams is tentatively expected to face trial in May 2019.

“It would have been difficult to select an impartial jury (in Skowhegan),” Paradie said.

After a four-day manhunt, John D. Williams is led away by Maine State Police detectives after his capture in Fairfield on April 28. He is accused of killing 61-year-old Cpl. Eugene Cole of the Somerset County Sheriff’s Office on April 25.

State prosecutors have indicated they will seek a life sentence for Williams.

Steve McCausland, spokesman for the Maine Department of Public Safety, referred all questions about the case to the Maine Attorney General’s Office.

“We will have no response to the comments that are being made by his attorneys,” McCausland said Thursday.

Assistant Attorney General Lisa Marchesi, who will be prosecuting the case, could not be reached for comment Thursday night. Initially, Williams had been incarcerated at the Maine State Prison, but he has since been moved to the Cumberland County Jail in Portland, Paradie said. A hearing on the motion to suppress statements made to police has not been scheduled yet.

According to court documents, Williams claimed he “got the drop” on Cole and shot him in the head after he tripped, fell backward and landed on the ground during a confrontation that took place in Norridgewock on April 25.

A manhunt that lasted four days resulted in Williams’ arrest in a wooded area of Fairfield. The manhunt involved about 200 officers from several jurisdictions.

On the day of his arrest, Williams, who was shirtless and barefoot, was led out of a wooded area by police. He was given a yellow blanket to cover himself from the waist down before being placed in a state police vehicle and driven away. Police confirmed they had used Cole’s handcuffs to restrain him.

Authorities addressed questions surrounding Williams’ treatment during his arrest, saying that he suffered a black eye while offering “limited resistance” during his apprehension and that a photo in which an officer is shown pulling Williams’ head up by the hair was necessary because he resisted having his picture taken and police needed to confirm his identity.

Police did not intend to release the capture photo to the public, but it was leaked on social media within an hour after it was taken. Police later confirmed that one of the arresting officers had taken the photo. The photo was later removed from the social media sites where it had appeared.

While the photograph of officers holding his head up will be used as evidence in the suppression hearing, Paradie said it won’t be the only point made in his arguments.

“My client was beaten pretty severely,” Paradie said. “There are rules around obtaining confessions and when we don’t follow those rules there have to be consequences.”

“I think the photo epitomizes what the officers did to him,” Paradie added.

Skowhegan police detective sergeant arrested Thursday

SKOWHEGAN — A Skowhegan police detective was arrested Thursday on a charge of domestic violence assault.

Detective Sgt. Don E. Avery turned himself in at the Somerset County Jail in East Madison and was released after meeting with a bail commissioner, according to a statement from Police Chief David Bucknam.

Avery, 36, of Fairfield, was booked at the jail at 1:40 p.m. Thursday.

He has been placed on unpaid administrative leave pending the outcome of the internal affairs investigation, which is standard procedure when incidents like that arise, Bucknam said.

The District Attorney’s Office is also reviewing the facts of the incident and the courts have sealed the warrant, therefore the facts and the allegations against Avery are not yet public, he said.

The booking log at the county jail indicates Avery was arrested on a warrant based on a complaint from an indictment.

“Both investigations are still very new,” Bucknam said. “The facts are still being gathered.”

Avery was hired in March 2016. His current annual salary is $51,667, according to Bucknam.

“As your police chief, I would like to stress that this agency is committed to transparency and I look forward to discussing this unfortunate incident more fully in the near future when the court system deems it appropriate,” Bucknam said in the statement. “Until that occurs, I want the residents to know that everyone in Skowhegan is accountable under the law. As unfortunate and sad as this incident is to me, let me be clear: No one in Skowhegan is above the law. Period.”

Avery was released on bail, but there is no information on a scheduled court date or if he has a lawyer yet.

Defense says no evidence ties Scott Bubar to weapons in police shootout in Belgrade

AUGUSTA — The defense attorney told a judge on Monday there’s no evidence tying Scott Bubar to any weapons used in a shootout with police that left his father dead in his Oakland trailer on May 19, 2017.

Bubar, 41, of Brunswick, is accused of aggravated attempted murder of Kennebec Sheriff Office Deputy Sgt. Jacob Pierce that night.

The prosecutor at Bubar’s trial Monday said Pierce returned fire after seeing through a window a muzzle flash from a shotgun held by a man wearing a green T-shirt.

Assistant District Attorney Alisa Ross held up both the green shirt that had Scott Bubar’s blood on it as well as the red shirt found on Roger Bubar, 65, that night. She used those exhibits during her opening statement in the non-jury trial of Scott Bubar at the Capital Judicial Center.

She said Pierce and Deputy Adam Bacon went to the door of the trailer that night. “Sgt. Pierce knocked and announced ‘Sheriff’s Office,'” initially getting no response until he repeated his actions. Then the men inside the trailer told them to leave immediately.

“Get out of here. We don’t want you here. Get out of here,” she said the officers recounted.

One man told them, “I will (expletive) shoot you; I have a shotgun,” Ross said, and the officers heard someone loading a shotgun, so they retreated.

Bubar was also indicted on a charge of reckless conduct with a dangerous weapon in connection with the same incident. The trial is on a two-day break Tuesday and Wednesday, and is scheduled to resume 8:30 a.m. Thursday.

Defense expert witnesses are expected to testify early next week.

Lisa Whittier, one of Bubar’s defense attorneys, said that in interviews with police, “Scott Bubar is steadfast that he did nothing but try to stop his father from shooting those firearms. He tried unsuccessfully to get those firearms out of his father’s hands.”

She told Justice Michaela Murphy, “The defense contends that the worst mistake of Scott Bubar’s life was leaving his apartment in Brunswick and spending the day with his father, Roger, on May 19 of 2017.”

Whittier said Roger Bubar drove his red Mustang to Brunswick to pick up his son, Scott.

She said a 12-gauge shotgun was found under Roger Bubar’s body in the hallway of the trailer and a 9-millimeter pistol was found nearby in the hallway. Whittier also said that in initial interviews, Pierce said he saw a man in a red shirt after the muzzle flash when he returned fire.

“He now recalls seeing a man in a green shirt after the muzzle flash,” Whittier said, “That’s a very significant departure from what Sgt. Pierce said hours after the event to now, 16 months later.”

Whittier said Roger Bubar owned both firearms, and that both had been seized by police in August 2008 and then returned to him at the end of that year.

“The physical evidence, the science, the DNA says Scott Bubar did not fire either weapon,” she said.

Whittier said that in order to convict Scott Bubar, the state needs to prove who was firing the weapons and that the shooter intended to kill Pierce, a police officer.

Police were called to Roger Bubar’s trailer by a series of complaints by neighbors reporting squealing tires, a red Mustang hitting the trailer and screaming voices.

Pierce, who was the first officer on the scene, reported hearing a male voice from inside the trailer say that they were “going out in a blaze of glory,” Ross said.

Bubar, who is being held at the Kennebec County jail, wore a dark jacket and tie over a white dress shirt. He was in shackles, with a chain wrapped around his waist, and shuffled from a side door to sit at the defense table in the courtroom.

Opening statements by attorneys were watched by one woman in addition to members of the media and Kennebec County Sheriff Ken Mason.

The initial witnesses called by the state, all neighbors of Roger Bubar and his girlfriend, Jenny Shorey, described hearing loud male voices and gunshots — two apparently before police arrived — as well as police sirens that night. Several of them called police. The witnesses walked over to a large monitor to point to the location of their homes on a large aerial view of the neighborhood.

One neighbor, Joshua Worcester, testified, “I did hear one (arguer) say that they were going to call the cops. The other one said, “‘Go ahead and call the cops.'”

He said he and his wife were worried about his family’s safety that night.

“When we first moved there Roger Bubar was in an armed standoff with police,” Worcester said.

The defense played a 911 audio record of Aletha “Ali” Short calling for help. “We have a crazy neighbor that drove his car into his house,” Short says, adding that she was afraid for her own vehicles in her driveway.

“They’re both so drunk, and now he’s coming over here,” she continued.

On the witness stand, Short testified that Scott Bubar drove the car into the side of the trailer. She said she could see what was happening because there were floodlights on the front of Bubar’s trailer.

Roger Bubar was struck three times by bullets from Pierce’s firearm and died at the scene, and Scott Bubar was hit once in the abdomen. One witness described seeing Scott Bubar crawling out of the trailer under police orders hours after the shooting stopped.

New Yorker sentenced to 23 months in Augusta drug conspiracy case

A former Rochester, New York, man serving time for dealing heroin in Augusta was sentenced Wednesday to 23 months in prison on federal drug conspiracy charges.

Alex Lamar Brumfield, 31, also known as “Izzo” and “Bob,” had pleaded guilty Nov. 8, 2017, in U.S. District Court in Bangor to the federal charge of conspiracy to distribute heroin and cocaine base.

He is currently serving 30 months at the Maine State Prison for unlawful trafficking, and his release date there is Nov. 30, according to the state Department of Corrections website.

The federal sentence, which is to be followed by three years of supervised release, was ordered to run concurrently with the state sentence.

Brumfield was living in Augusta when the unlawful trafficking and unlawful possession offenses occurred.

Complaints filed at the Capital Judicial Center alleged that Brumfield was dealing drugs from a Washington Street apartment, where a confidential informant with a recording device bought cocaine and heroin from him in September 2016. They also say Brumfield sold heroin on Nov. 3, 2016, from a North Street apartment, also in Augusta. Some court documents list a Windsor address for Brumfield as well.

He has been in state custody since being arrested Nov. 9, 2016, in Augusta. At that point, investigators reported seizing illegal drugs and a firearm.

Brumfield is one of 16 co-defendants charged federally with conspiracy to distribute heroin and cocaine base June 14, 2015, and March 9, 2017, brought from Rochester, New York, to sell in central Maine.

Assistant U.S. Attorney Joel B. Casey wrote in the prosecution’s version of events that Brumfield “was one of many dealers from Rochester sent to Maine to sell drugs.”

Casey also said, “As part of his role in the conspiracy, (Brumfield) would stay in the residences of other co-conspirators for extended periods of time and sell drugs. He would collect proceeds from the sale of the drugs and hold them until another conspirator collected the proceeds and arranged for them to be sent back to Rochester.”

Most of the defendants in the case have entered guilty pleas and several others have been sentenced.

The federal sentencing hearing for Brumfield had started April 19 but was halted after Brumfield spoke, according to a defense memo, “when the government and court expressed concerns that some of Mr. Brumfield’s statements put his acceptance of responsibility in jeopardy.”

The defense sentencing memo, filed by attorney James Hewes, cites a presentencing investigative report saying that Brumfield might be entitled to a somewhat lower sentence because of his “substance abuse history, his exposure to the drug culture both inside his home and community, his lack of any prior criminal history, and his extensive amount of prosocial family support.”

Hewes wrote that “Alex was a worker and not a leader in the conspiracy.” Hewes also asked that Brumfield’s federal sentence run concurrently with the state sentence.

Judge finds Bridgton man not criminally responsible for killing former brother-in-law

A Superior Court judge has ruled that a Bridgton man fatally shot his former brother-in-law but was not criminally responsible at the time.

Deputy Attorney General Lisa Marchese said David Pinkham has now been committed to Riverview Psychiatric Center. Pinkham killed 66-year-old Charles Cross outside his Sebago home in 2016, and his mental competency had been in question from the beginning of his case. Justice Lance Walker issued the ruling July 20.

Cross had been married to Pinkham’s sister for more than 20 years before they divorced about two decades ago. Police said the two men remained friends after the divorce. Pinkham had visited Cross at home on March 5, 2016. They chatted in the kitchen and then walked outside. Cross’ longtime girlfriend was in the living room when she heard a “pop-pop” noise outside.

“She looked out the window and saw Cross laying in the snowbank,” a state police affidavit says.

Pinkham drove off, and Cross’ girlfriend called 911. Police in Bridgton pulled over Pinkham’s car about 10 minutes later and saw he had a Taurus .38-caliber revolver in plain view on the front passenger seat. Police later determined that Pinkham bought the gun less than two weeks before the shooting, the affidavit says.

He was arrested immediately and indicted on a murder charge the following month. The motive for the shooting was unclear, and his attorney had said Pinkham was not competent to stand trial.

ARRESTS

IN AUGUSTA, Wednesday at 10:21 a.m., Amanda McCarthy, 32, of Sidney, was arrested on a warrant, on Winthrop Street.

8:41 p.m., Stephen A. Wright, 37, of Augusta, was arrested on a probation hold and a charge of operating after a habitual offender revocation, after someone complained about traffic on Franklin Street and Northern Avenue.

9:44 p.m., Christopher Ellis Williams, 27, of Augusta, was arrested on charges of burglary and theft by unauthorized taking or transfer (less than $500), after a past burglary was reported on Cross Hill Road.
