Civil settlement says elderly patient gave Brunswick nurse $600,000

A Brunswick nurse who has been charged with financial crimes had received more than half a million dollars from an elderly patient, according to a lawsuit that was settled while the criminal investigation was underway.

Amy McLellan, 61, was indicted last week on felony counts of theft and misuse of entrusted property of a vulnerable person. She owns The McLellan, an apartment complex for seniors that opened last year. Few details about the criminal case were available in the wake of the indictment, but a civil complaint filed last year provides details about the circumstances that led to the charges.

The lawsuit states David Fratus first met McLellan when he was admitted to Central Maine Medical Center to be treated for Parkinson’s disease and delirium in early 2016. Fratus and his wife, Frances, have few surviving relatives except a granddaughter who lives out of state. At the time their complaint was filed last year, the husband and wife were 89 and 92, respectively.

“Amy was my nurse and she befriended me,” Fratus wrote in his affidavit in the lawsuit.

In April 2016, McLellan persuaded Fratus to give her power of attorney, the lawsuit alleged. Over the next sixteen months, she allegedly requested hundreds of thousands of dollars from him, in amounts ranging from $14,250 to $200,000 at a time. McLellan told David Fratus she needed the money to help build and operate The McLellan, he wrote in his affidavit. The couple eventually moved into the new apartment complex.

By August of last year, McLellan had received $588,250 from the Fratuses’ accounts, the lawsuit alleged.

“I have given Amy almost all of my life savings,” Fratus wrote. “I have no other assets.”

‘HOUSE OF CARDS IS READY TO FALL’

In October, McLellan was reported to the Brunswick Police Department and the Maine Department of Health and Human Services for suspected financial exploitation. It is unclear who made the report. Later that month, the police executed a search warrant at McLellan’s apartment and helped move David and Frances Fratus to a different senior housing facility. A spokesperson from the state DHHS has declined to comment on the case and did not respond to questions Wednesday.

In December, the couple filed their lawsuit in Cumberland County Superior Court. Their attorney, Daniel Stevens, also asked for a court order to seize McLellan’s assets, which was granted.

“The house of cards is ready to fall for Ms. McLellan and her companies,” Stevens wrote in his motion.

The parties reached a settlement in January. Stevens said Wednesday that he could not confirm the amount of the settlement, but that it “serves to reimburse” the couple.

“Some of the monies transferred to Ms. McClellan were for legitimate housing costs, while others were not,” he said in an email. “The attorneys for the parties reviewed those transfers and agreed upon an amount that should be repaid to Mr. and Mrs. Fratus. The majority of those funds have already been repaid and there is an agreement with regard to future payment of the balance.”

On Friday, a Cumberland County grand jury indicted McLellan on criminal charges. She is accused of misusing property entrusted to her by David Fratus, resulting in a loss of more than $10,000. She also is accused of committing theft “by obtaining or exercising unauthorized control over a business loan, property of Norway Savings Bank, of a value more than $10,000, with the intent to deprive Norway Savings Bank of the property.”

Assistant District Attorney Amanda Doherty said the second charge is related to allegations that McLellan wrongfully obtained her loan by misrepresenting where she was getting the money that would serve as collateral.

McLellan’s lawyer, Kristine Hanly, provided a statement about the criminal indictment via email Tuesday evening.

“A contract dispute arose between Mr. Fratus and Ms. McLellan,” Hanly wrote. “Through their respective attorneys, they resolved the matter in civil court to the satisfaction of both parties. Accordingly, Mr. Fratus dismissed his civil complaint against Ms. McLellan. The mortgage held by Norway Savings Bank has been paid in full. It is unclear to me why the state is expending time and resources prosecuting Ms. McLellan in a matter that is civil in nature and has already been resolved to the benefit of all parties.”

Hanly did not answer further questions about the lawsuit Wednesday evening.

‘AN OBLIGATION TO PROTECT VICTIMS’

Stevens disagreed with the characterization of the case as “a contract dispute.”

“The heart of all these claims is that Ms. McClellan took financial advantage of some wonderful senior citizens whom she befriended,” Stevens said. “Fortunately, there are laws in Maine to protect our senior citizens, and my office is pleased to have been able to represent Mr. and Mrs. Fratus in seeking to hold Ms. McClellan accountable.”

Doherty said that a financial settlement does not mean the Fratus family has been made whole financially, and that the criminal and civil processes are not mutually exclusive.

“The state has an obligation to protect victims and the community at large, and ensure that people are held accountable for their criminal activity, which also serves to warn the public of consequences for these types of actions,” she said. “That is why the time and resources Attorney Hanly speaks of are being spent – and it is worth every moment to see justice prevail.”

McLellan purchased a former nursing home on Cumberland Street in Brunswick in 2016 and renovated it to become an assisted-living space for people 62 years or older. The building has 18 apartments in addition to an owner’s residence. McLellan told The Times Record in a 2016 interview that she would be the resident nurse on the property.

The McLellan’s website lists monthly fees between $2,300 and $4,500, along with a refundable entry fee between $35,000 and $85,000. Additional fees might apply for a second person in the apartment, or for a garage space. The monthly fee includes one meal a day, as well as amenities such as a fitness center and a community garden.

A background check showed McLellan does not have a criminal record in Maine. The two charges are Class B crimes, punishable by up to 10 years in prison and a $20,000 fine. She will be arraigned Sept. 18 in Cumberland County Superior Court.

Charges dismissed against Maine man driving boat that killed his twin brother

The York County District Attorney’s Office has dismissed all charges against a Sanford man in connection with a 2016 boating accident that killed his twin brother, citing a judge’s decision to grant a motion to suppress results of a blood alcohol test.

Jonathan Beattie, 33, of Sanford had been indicted in November 2016 on charges of manslaughter, reckless conduct with a dangerous weapon and operating watercraft under the influence causing serious bodily injury or death. He also was indicted on a misdemeanor count of operating a watercraft under the influence.

In a filing in York County Superior Court on Tuesday, York County Deputy District Attorney Justina McGettigan said that her office decided to dismiss all four charges because Superior Court Justice John O’Neil Jr. granted a June 11 motion by Beattie’s attorney to suppress the results of a blood alcohol test and statements Beattie made to police on the day of the accident.

“The court granted the defendant’s motion to suppress after a full hearing,” McGettigan wrote in her dismissal filing. “Without the information regarding the defendant’s statements and other information, the state cannot meet the high burden of proof beyond a reasonable doubt.”

Jeffrey Beattie was killed on May 28, 2016, when he fell off the bow of the boat his brother was operating on Mousam Lake in Shapleigh.

Investigators said the motorboat ran over Jeffrey Beattie, who was initially taken to Southern Maine Health Care in Sanford before being flown by helicopter to Maine Medical Center in Portland, where he died from his injuries.

According to the motion filed by Timothy Zerrillo, Jonathan Beattie’s attorney, a police officer and game warden never performed a field sobriety test on Jonathan Beattie, instead informing him that he had a “duty” to consent to having his blood drawn. Beattie verbally agreed and gave a blood sample at Southern Maine Health Care, but Zerrillo said in court documents that the officers never sought or obtained a warrant.

The lawyer also told the judge that the officer and warden did not allow Beattie to accompany his brother to the hospital in the ambulance, and then they questioned him for 5 to 10 minutes.

O’Neil called the blood test “an unreasonable search in violation of the Fourth Amendment” and noted that Beattie’s interrogation by police was made without a Miranda warning.

Documents Zerrillo filed in York County Superior Court in March describe what started out as an enjoyable, late spring day boating on Mousam Lake. The identical twins were joined on the motorboat by two friends and Jeffrey’s wife, Jennifer Beattie.

“Jeffrey had one knee on the bowrider seat and his foot on the floor. As they turned, Jeffrey went over the side. The prop clipped him on the way by, and a fun day turned tragic,” Zerillo wrote. “The group immediately fished Jeffrey out of the water and began trying to stop the bleeding.”

Zerillo said that while his client is relieved that the charges against him have been dropped, he may never fully recover from the death of his brother. Jeffrey Beattie left behind his wife and two young children.

“We got the best possible result in the criminal case,” Zerrillo said in a telephone interview Thursday evening. “But it is an absolute tragedy for him and his family.”

Wilton woman charged with arson in Farmington house fire

FARMINGTON — A Wilton woman was arrested Friday for allegedly setting fire to an Industry Road home earlier this month after a fight with her boyfriend, according to the state Fire Marshal’s Office.

Angie Clark, 38, was arrested on charges of arson and aggravated criminal mischief, according to Steve McCausland, spokesman for the Maine Department of Public Safety.

Clark was taken to the Franklin County Jail on Friday afternoon, where her bail was set at $10,000.

Investigators said Clark set fire to the home at 732 Industry Road on Aug. 6 after having a fight with her boyfriend, Robert Nadeau, who owns the house.

“Clark and Nadeau had a verbal argument at the home and when Nadeau left, Clark set the house on fire before leaving the scene,” McCausland wrote in a statement.

No one was hurt in the fire.

The house was not insured.

Officials located Clark the day after the fire. She was taken to a hospital for evaluation, and remained there until Friday.

Once released from the hospital, she was immediately arrested, police said.

Transportation, cancer among reasons cited by no-show jurors summoned by judge to Skowhegan court

SKOWHEGAN — The men and women who approached Superior Court Justice Robert Mullen’s bench Tuesday cited all sorts of reasons for why they had not shown up for jury duty.

They were sick, had no transportation, were required to be at their jobs — or never received a letter informing them they were chosen.

Mullen had called the dozen or so residents to Somerset County Superior Court on Tuesday morning, not to threaten or berate them, he said, but to find out why they did not show or let the court know why.

He was cordial, thanked them for coming and said he appreciated their input.

He also did not reveal their names and instead called them by number, explaining beforehand how critical it is for people to serve as jurors, that it is an obligation and that they need to be part of the system to make a difference. Justice, he said, depends on the quality of the jurors who serve.

“If jury duty was not mandatory, I’m very concerned if we have enough jurors at all,” he said.

Some of those who showed up Tuesday had not responded to more than one request to appear for jury duty.

When Mullen called “number 28” to the lectern, an older man whose head was wrapped in gauze bandages approached. Mullen asked why he had not come to court the first time he was called for jury duty. The man later identified himself to the Morning Sentinel as Urban Clukey, of Cambridge.

“I had no way to get to the court,” Clukey told Mullen. “This month, I have health issues. I have cancer.”

Mullen said he was sorry to hear that and inquired about a doctor’s letter.

“If I had gotten that information, I wouldn’t have sent you a letter and we wouldn’t be talking here today,” Mullen said.

Clukey said he had been waiting for a letter from the court telling him he had been excused from jury duty. Mullen asked him to check with the court clerk to make sure she had Clukey’s address, told him he would get a letter in November when jurors are requested again and if Clukey still did not feel well, the court would work with him.

“Let us know, and we’ll excuse you,” he said.

Mullen, the state’s deputy chief justice, said recently that the prevalence of no-show jurors threatens the court’s ability to hold trials and get verdicts. Those who do not show up potentially face fines or jail time if they ignore follow-up calls to report to the courthouse.

The law includes a stipulation that if people who do not show up for jury duty are found in contempt, they could face a fine of up to $100 and up to three days imprisonment, or both.

The problem of no-shows is not specific to Somerset County, according to Elaine Clark, communications director for the Maine Judicial Branch of state government, who said last week that other regions struggle with it. The courts, she said, are flexible with potential jurors and schedules, but they must not ignore notices and must get in touch with the court if they have problems.

Taylor Hall, 20, of Pittsfield, said she does not have a vehicle or a way to get to the court. Mullen said he empathizes with her transportation problems, but the flip side is if everyone said they couldn’t get to court, there would be no jurors.

He asked if her situation would be better in November and said all judges are willing to work with potential jurors. He added that the chances are good she would not get chosen if the pool of jurors is adequate.

“I’d like to work with you if I could, but I’d also like a representative jury pool,” he said.

Jurors get paid $15 a day and 44 cents a mile for travel, a cost Taylor said afterward, outside the courthouse, presents a problem for her, as she doesn’t own a vehicle and must pay someone to drive her to court if she is placed on a jury.

“I know it’s $15 a day but a full day of work and $15 a day — it’s difficult, it’s hard,” she said.

Hall said she understood what Mullen was saying about the importance and need for people to serve on a jury. She had sent the court a letter saying she couldn’t make it for jury selection but did not get a response, so she did not show up and then received a letter requiring her to appear Tuesday.

“I was very nervous,” she said. “I was like, this was not my fault. It’d be different if I owned a vehicle.”

Hall said she wouldn’t mind serving on a jury and felt better after talking with Mullen.

“He’s really nice. He seemed very understanding.”

A middle-aged woman said she had dental problems when she was called in 2015, but did not receive the latest request for jury duty and knew about Tuesday’s session only when she got a letter from the court telling her to show up.

“I am at a loss as to why that is,” Mullen said of why she would not have received a letter for jury duty.

The woman said she would have appeared, had she received it.

“I would have been there,” she said.

Mullen asked about whether attending the upcoming November jury selection would be a problem for her.

“I work for the school district and I am the only cook,” she said. “It all depends if I get a sub or not.”

She said summer is not a problem, as school is not in session. As with the others, Mullen asked her to make sure the court has her correct address and they would “see how it goes in November.”

A middle-aged man said he owns two businesses and doesn’t have the luxury of having much time off.

“I will do whatever is possible to try to limit your exposure, but again, if I excuse everyone who is a sole practitioner or owns a business, we wouldn’t have anybody,” Mullen said.

Earlier, he cited eight reasons the National Judicial College lists for why jury trials are important, including that the American jury trial is a constitutional right and a vital part of the American system of checks and balances, the founding fathers included trials in the U.S. Constitution because they prevent tyranny, trial by jury is a unique part of America’s democracy and they provide an opportunity for people to take part in governing.

Also, jury trials educate jurors about the justice system, provide a method for peaceful dispute resolution and offer the voice of the people to the civil and criminal justice systems, Mullen said.

Gorham man jumps out of moving car to escape police in Somerset County

A Gorham man with a history of escaping from authorities has eluded police once again, this time by jumping out of a moving vehicle in the Somerset County town of Caratunk, police said.

A deputy with the Somerset County Sheriff’s Office had attempted to pull over a vehicle driven by Corey W. Paradise, 45, on Monday on Canada Road, or U.S. Route 201, in Moscow, according to a Facebook post made by the sheriff’s office Thursday.

When he refused to stop, the deputy followed Paradise to Main Street in Caratunk, where he jumped out of the car and fled on foot, the post said.

Earlier this month, Paradise jumped out a window at a construction site in York after officers had used Taser stun guns on him. He fled barefoot into a nearby wooded area in the midst of a thunderstorm.

The sheriff’s office said information has been received that Paradise was spotted walking south Tuesday morning on Carry Pond Road, about 3 miles north of Pleasant Ridge Plantation.

He was last seen wearing a blue sweatshirt, tan shorts and camouflage Crocs.

Paradise is the subject of multiple outstanding arrest warrants and is wanted by Somerset County on multiple charges stemming from a burglary.

In addition to the incident earlier this month, Paradise also led Scarborough police on a long, bizarre car chase that at times involved unusually slow speeds and ended with him being found hiding under a porch in 2014.

He has ties to the Jackman, Scarborough and Gorham areas.

Police investigate body found in Augusta

AUGUSTA — Police are investigating at the scene where a body was found Thursday afternoon on Weeks Mills Road.

“Detectives from the Augusta Police Department were following up leads on a missing person case and during the course of the investigation Detectives located an unidentified body,” Augusta police said in a news release sent about 8:30 p.m.

The Maine State Police Major Crimes Unit van was on the scene, which is close to the intersection with North Belfast Avenue, also called Route 3, in the northeast section of the city.

The area is heavily wooded, and yellow tape cordons off a section of the forest close to the road.

A state trooper at the scene about 7:30 p.m. Thursday said he had no information about the body and would not say whether it was an adult or a child, or whether it was a possible suicide case.

Police said in the release the identity of the deceased person was not yet known.

By 8 p.m. the state police van was gone from the scene.

IN MONMOUTH, Monday at 6:47 p.m., harassment was reported on Route 135.

ARRESTS

IN AUGUSTA, Monday at 2:35 p.m., Stacy M. Haskell, 37, of Augusta, was arrested at the Kennebec County jail and charged with failure to appear.

3:22 p.m., Jessica L. Pooler, 31, of Benton, was arrested on Winthrop Street on warrants.

6:11 p.m., Joshua Michael Roderick, 30, of Randolph, was arrested at the intersection of Laurel and State streets and charged with theft, operating while license suspended or revoked and operating under the influence.

8:47 p.m., Gerard Roland Cormier, 35, of Augusta, was arrested on a warrant and charged with unlawful trafficking in scheduled drugs and sale and use of drug paraphernalia. Gerald Richard Sounier, 42, of Augusta, was arrested on a warrant, and charged with refusing to submit to arrest or detention, violating a condition of release, unlawful possession of scheduled drugs and being a fugitive from justice, after an incident outside The Big Apple store on Stone Street. Additional information was not immediately available from police.
