Police find Hartland man hiding in basement of smoke shop

A Hartland man was released this week into the Somerset County Community Corrections Program after his arrest Sunday night when police found him hiding in a Madison head shop, allegedly with stolen merchandise.

Christopher Gagne, 26, was found in the basement of Wicked Lettuce, described with a marijuana leaf logo on its Facebook page as being a “Bright and Cheery Smoke Shop located in Downtown Madison, ME.”

Somerset County Sheriff Dale Lancaster said Gagne had stolen items with him that included glass pipes, seeds, marijuana edibles, jewelry and other cannabis products. The value was estimated to be more than $2,000, the sheriff said.

The business operators are licensed medical marijuana caregivers and offer caregiver services and products during store hours to their patients.

Lancaster said the Somerset County Sheriff’s Office responded to a report of a possible burglary in progress at 11:14 p.m. Sunday at the shop on Main Street in Madison.

Cpl. David Cole, of the sheriff’s office, responded to the call and learned that the owner of Wicked Lettuce reported seeing a person in the store on the in-store surveillance system. Cole discovered that the rear door had been opened forcibly.

“Upon meeting with the owner at the store and reviewing the surveillance footage it was determined the individual responsible was still on the premise,” Lancaster said in an email.

He said Cole and Deputy Craig Dyer did a search of the building and found a hole in the basement wall that was covered by Styrofoam. Once they removed the Styrofoam, the hole led into another basement, where two backpacks were found.

Lancaster said the backpacks matched backpacks seen on the surveillance video. Deputies found Gagne hiding in a corner. He was arrested and taken to the Somerset County Jail in East Madison.

All of the reported stolen items were recovered and returned to the owner, Lancaster said. He said Gagne admitted the burglary.

Gagne was charged with burglary, class C; theft, class C; and criminal mischief, class D.

Gagne was arraigned Monday morning and placed on the Somerset County Community Corrections Program. He is scheduled to appear May 23 in the Somerset County Unified Court.

The shop was burglarized once before, Lancaster said, on Dec. 9, 2017.

“That case is still an active investigation,” he said.

In a statement emailed Tuesday to the Morning Sentinel, Faith Goguen, co-owner of Wicked Lettuce, said the business is a family operation.

“We are strong family-owned business and thankfully installed surveillance cameras and motion detectors,” Goguen said. “This alerted us to the fact he was there immediately, so we phoned the police and came right down.

“While this was an unfortunate incident, we will not allow it to get in the way of what we do here. We will rise above and continue on serving our customers, patients and this wonderful community that we now call home.”

New York man convicted on charges linked to firing gun at Augusta Walmart parking lot

A New York man indicted 13 months ago by a federal grand jury was found guilty of weapons and trafficking charges Wednesday in U.S. District Court in Bangor in connection with an incident two years ago when he fired a gun in a Walmart parking lot in Augusta.

Reginald McBride had been charged with being a prohibited person in possession of a firearm, possession with intent to distribute heroin and “carrying and discharging a firearm during, in relation to, and in furtherance of a drug trafficking crime.”

McBride was one of four people arrested in June 2016 after shots were fired at the Augusta Walmart two armed bystanders broke up the exchange of gunfire.

At the time, police said two of the four people arrested had fired guns at each other during a dispute in the Walmart parking lot. Police said the incident was a dispute over drugs and money.

The federal indictment said McBride fired a pistol to further the drug deal.

Court records indicated he previously had been convicted of three felony charges in Virginia and one in New York.

Jeffrey Silverstein, McBride’s attorney, said on the third charge, the jury convicted McBride of carrying a weapon but not of discharging it.

Had he been convicted of the all the elements in that charge, he would have faced an additional mandatory 10-year sentence. Now his potential sentence would be reduced by five years, Silverstein said.

On his conviction for possession of a firearm by a prohibited person, McBride could be sentenced to not more than 10 years a $250,000 fine or both. On the possession with intent to distribute heroin conviction, he could be sentenced to not more than 20 years, a $1 million fine, or both.

Sentencing is expected to take place this summer.

The federal charges came after McBride, of New York City’s Harlem district, was indicted in September 2016 at the state level on charges of attempted murder, aggravated trafficking in scheduled drugs, reckless conduct with a firearm, and four counts of possession of a firearm by a prohibited person.

Pamela Ames, McBride’s attorney on the state charges, said his state charges will continue until the federal charges are resolved.

Court papers show that McBride has a variety of aliases, including Kweasia McBride, Anthony Walker and Sunny.

They also show he has listed a variety of ages. According to the date of birth provided by Ames, McBride is 47.

A year ago, Frankie DeJesus, of Rochester, received a two-year deferred disposition after pleading guilty to a charge of reckless conduct with a dangerous weapon. The special conditions of his deferred disposition require that he depart Maine and return only for meeting with his attorney or for court proceedings.

At the same time, Samantha E. Tupper, of Augusta, pleaded no contest to a charge of hindering the apprehension or prosecution of McBride, a co-defendant in the case. Police said Tupper drove McBride away from the scene.

Tupper was sentenced to five months in jail, a term that is to run concurrently with a nine-month probation revocation. At the time of the incident in the Walmart parking lot, Tupper was on probation on a conviction for unlawful furnishing of scheduled drugs. In exchange for her plea a charge of unlawful furnishing of scheduled drugs dated June 26, 2016, against her was dismissed, as was a charge of trafficking in prison contraband from an incident July 6, 2016, at the jail in Augusta, when she was allegedly in possession of a syringe.

A fourth person charged after the parking lot incident, Diana M. Davis, of Rochester, New York, who identified herself in court as a sister of Dejesus, pleaded no contest to an assault charge Dec. 7, 2016, and was sentenced to 100 days in jail and given credit for time served, and a $300 fine was suspended.

North Monmouth man charged with stealing cash, medical marijuana, video camera

A North Monmouth man faces multiple charges after he allegedly stole money, medical marijuana, a smoking device and surveillance equipment from a home near downtown Monmouth, then ditched the surveillance equipment as he drove away from the scene.

Some of that equipment was destroyed, but police still were able to recover video that showed Ronald R. Hinkley Jr., 18, entering the home and pocketing a security camera that sat atop a refrigerator, authorities allege in court documents.

In part because of that video, Monmouth police confronted Hinkley, and he admitted having broken into the home on Berry Road, Officer Dana Wessling wrote in a probable cause affidavit.

Wessling arrested Hinkley on Friday last week, charging him with burglary, theft by unauthorized taking or transfer, criminal mischief and stealing drugs.

Hinkley was taken to Kennebec County jail in Augusta, then released Monday after a judge set his bail at $2,000 cash. During Hinkley’s initial appearance at the Capital Judicial Center, he did not offer a plea, according to court documents.

Police have accused Hinkley of taking $4,000 in cash from a man who lived at the home on Berry Road. The man reportedly was saving that cash to buy a car.

Police also accused Hinkley of taking the security camera and a related piece of equipment, which were valued at $400, and throwing that equipment out the window of his red Dodge pickup truck as he drove away from the scene.

Later, the victim told police he also was missing medical marijuana and a water pipe that he used to smoke it, which had a $100 value.

When Wessling spoke with Hinkley, he allegedly admitted having taken the money and spending a portion of it, buying $1,100 worth of marijuana concentrate from someone in Wayne, and $600 in merchandise from a head shop in Hallowell.

He still had about $975 on him, police said, but it’s not clear what happened to the remaining cash. According to Wessling, Hinkley said “he cannot remember where the other $1,200 went.”

Hinkley returned the water pipe to police, Wessling said, but he told them that he already had smoked the medical marijuana from the Monmouth home.

He also helped police recover the video system that he allegedly had taken and thrown out of his car, but some of the equipment was smashed to pieces and a camera couldn’t be found. Wessling didn’t indicate how he was able to view video captured by the equipment.

Burglary and theft are class B and c felonies, respectively, each punishable by more than a year in jail. The other two charges are each class D misdemeanors. Hinkley’s next court appearance is scheduled for May 15.

Waterville woman’s lawsuit against T-Mobile, linked to #MeToo movement, heads to trial

A Waterville woman’s allegation of unlawful sexual harassment by a supervisor from a T-Mobile call center in Oakland is on track to go to trial in federal court.

Angela Agganis had filed a lawsuit in U.S. District Court in Maine in October 2015, shortly after holding a news conference outside the Oakland call center, where she had worked for eight years, to complain about working conditions and other practices.

On Monday, U.S. District Judge D. Brock Hornby ruled that the case can continue to trial on the claim that Agganis was subject to a hostile work environment when she was repeatedly sexually harassed by Gary Rochon, who became her coach at T-Mobile in March 2014.

The complaint says “Rochon began to sexually harass her, including, inter alia, repeated and unwanted physical contact with Agganis on at least three occasions, unwanted staring at Agganis in a sexual manner, and offering Agganis a ride home on the first day she began working for him in direct violation of T-Mobile USA’s no fraternization policy.”

One of Agganis’s attorneys, Valerie Z. Wicks, said in a prepared statement sent out Friday that “this decision is important because it reemphasizes that it’s not enough for an employer to simply have a sexual harassment policy, it must have an effective one. A policy is not effective if women are subjected to sex-based slurs, unwanted massages, and leering in the workplace.”

The statement was accompanied by the hashtag #MeToo Sexual Harassment, a reference to the movement in which a number of women have reported being sexually harassed and assaulted in the workplace. Those reports have led to scores of resignations by influential men and to loss of contracts — and to some apologies.

Wicks said Friday afternoon that while the lawsuit predates the #MeToo movement, “This was a case where Ms. Agganis was not the only customer service representative in the Oakland call center who received this type of treatment from this supervisor,” Wicks said on Friday afternoon. “Another woman had come forward previously and others came forward later.”

Agganis had worked for T-Mobile USA, Inc. for eight years prior until quitting in August 2014.

Agganis said she complained about sexual harassment, including inappropriate touching, to Karen Estes, T-Mobile’s human resources manager, and quit immediately after signing a confidentiality agreement prohibiting her from discussing the investigation with anyone. The company’s confidentiality rules were later changed.

Agganis then went public with her case. She also enlisted aid from labor unions, including the Communications Workers of America, and appeared in a video for that labor union, talking about her treatment at T-Mobile.

In his decision following March 7, 2018, oral arguments, Hornby wrote, “The parties hotly contest whether this former employee was sexually harassed at all and if so whether that harassment was objectively offensive and severe or pervasive. Crediting the plaintiff’s version of events where supported by the record as I must at summary judgment . . . I conclude that she has raised triable issues of fact on sexual harassment sufficient to go to a jury.”

The judge also made several other rulings in the case, saying that Agganis cannot recover back pay because she was not compelled to resign.

He also wrote, “I conclude that there is a jury issue on whether the defendant exercised reasonable care to prevent and correct promptly any sexually harassing behavior. A few months before (Agganis) made her complaint about the coach, his conduct had already come to HR’s attention. It was reported that the coach made two suggestive comments to a different customer service representative about her attire that made her uncomfortable. That CSR reported at least one of the comments to a manager, who informed HR.”

Later, Hornby noted, the coach was “counseled” about sending a sexually suggestive cartoon to his team, a violation of the sexual harassment policy.

“A reasonable jury could conclude that the failure ever to address the clothing incident showed that the employer’s implementation of its policy was inadequate,” Hornby said.

According to the complaint, Rochon had been accused of sexual harassment at previous workplaces, and in June 1996, he had surrendered his medical license in Wisconsin after one of his patients said he had sex with her. In a videotaped deposition taken in the offices of Agganis’s attorneys in September 2016, Rochon denies sexually harassing Agganis and says he occasionally gave representatives on his team “a squeeze” or touch on a shoulder to indicate “good job” or touched their hand to redirect a computer mouse.

Wicks, one of Agganis’s attorneys, said that Ms. Agganis has held other jobs since working for T-Mobile, and that she would be unavailable for comment. The case is currently listed for May 7 jury selection in U.S. District Court in Portland.

In the same release, Agganis is quoted as saying, “No working woman should have to endure sexual harassment on the job. And no woman should be denied the right to speak to others about what occurred. I hope this suit will ensure that women working

at T-Mobile are treated with the dignity and respect they deserve and encourage women everywhere to come forward and put an end to intolerable working conditions.”

Rochon was never a defendant in the case. “He left the company some time after Ms. Agganis’s complaint, but he was not fired as result of it,” Wicks said.

Richard Moon, the lead attorney representing T-Mobile, did not return a request for comment sent Friday afternoon via another attorney at the Verrill Dana law firm in Portland.

Judge allows Eastport man in manslaughter case to go outside Riverview

AUGUSTA — An Eastport man found not criminally responsible last June for manslaughter won a judge’s approval Friday to be out of Riverview Psychiatric Center and in the community for up to six hours, as long as he has one-to-one supervision by a Riverview worker.

Hazen McDugald, 41, sat quietly with his attorney as both his treating psychiatrist and a psychologist with the State Forensic Service agreed that being off hospital grounds would be therapeutic for him.

At the conclusion of the hearing Friday in the Capital Judicial Center, Justice Joyce Wheeler said she concluded that granting the petition for modified release for McDugald “can be undertaken without risk to community.”

She also addressed McDugald directly, warning him that the privilege can be revoked if anything goes wrong and that the court, the prosecutor’s office and others are notified within 48 hours if any violations occur.

Wheeler said McDugald seemed to be particularly attentive to what was happening during the hearing.

“I’m assuming you get it,” she said.

“Yep,” McDugald said from his seat.

He did not testify. Generally those seeking changes do not testify at hearings on petitions for changes in the conditions under which they are held. This is the first time he has petitioned the court for such changes. Those found not criminally responsible for offenses are permitted to file petitions for changes at six-month intervals.

McDugald was found not criminally responsible for both manslaughter in the September 2015 death of Maurice Harris, 75, in Eastport and for aggravated assault in a February 2016 attack on a corrections officer at the Washington County jail.

He was committed to the custody of the commissioner of the Department of Health and Human Services and placed at Riverview for treatment.

Dr. Mary Tibbetts, a staff psychiatrist at Riverview, testified Friday that McDugald was one of the 12 patients she manages and that she encounters him almost daily as well as meeting with him weekly.

In response to questions by McDugald’s attorney, Harold Hainke, Tibbetts said McDugald’s current diagnosis is “a major depressive disorder with psychotic features” and possible schizoaffective disorder.

“It’s a very interesting and tragic case,” Tibbetts said, noting that McDugald had a good upbringing and worked all his life. She said problems developed after a 1,200-pound block was dropped on him accidentally by the owner of a fishing boat he was working on, and that over the next 10 years he abused substances, largely opiates.

She said he had spent two weeks in a cold-turkey detoxification program in 2015, and then five months later attacked his father because he feared his father was plotting against him.

McDugald was found guilty in that incident and spent 55 days in jail but did not receive mental health treatment, she said.

Tibbetts said she had adjusted McDugald’s medication regimen recently because she felt his depression was “undertreated” and that she has seen improvement. She also said she has not seen any psychotic symptoms.

Tibbetts told the judge, “We would incrementalize his privileges. We would start low and go slow.”

Nadir Behrem, a psychologist with the State Forensic Service, which evaluates patients for the court, testified that McDugal had the “delusional belief that he had to kill victims under orders of the intelligence community or be killed himself.”

Behrem said that with the supervision recommended, “being able to be in community is a good step” for McDugald and would “put him on path to becoming more independent in the future.”

Wheeler said, “I think it sounds like he’s made a lot of progress” and complimented Tibbetts for her treatment of McDugald and for making the medication adjustments to support his going out in the community with eyes-on supervision.

Assistant Attorney General Laura Yustak questioned the witnesses on behalf of the state and told Wheeler that the testimony provides additional basis for the court’s decision.

Wheeler also had an institutional report prepared by McDugald’s treatment team and the Behrem’s report. Both documents remain under seal.

Pair held on Waterville drug trafficking charges near ‘safe zone’

AUGUSTA — A New York man and an Augusta woman spent the weekend in Kennebec County jail on drug trafficking charges stemming from incidents in Waterville in November 2017.

Jahsun Campbell, 28, and Shantasia N. Bethea-Lucas, 26, were arrested Friday afternoon and held in lieu of $50,000 cash bail that was set with the arrest warrant.

Campbell, of Bronx, New York, is charged with two counts of aggravated trafficking in cocaine base, one on Nov. 1, 2017, and one on Nov. 14, 2017. Police say both drug transactions took place near property designated as a drug-free “safe zone.”

Bethea-Lucas, of Augusta, is charged with two counts of unlawful trafficking in cocaine base, both on Nov. 14, 2017.

They made initial court appearances Monday at the Capital Judicial Center via video link with the jail. At that hearing, Judge Eric Walker ordered bail of $10,000 cash with a Maine Pretrial Services contract for Campbell, the amount requested by Assistant District Attorney Chris Coleman.

According to an affidavit by Waterville Police Officer Daryl Gordon, two other officers using a confidential informant conducted a controlled buy of 0.60 crack cocaine from a man known as “Tory” on Nov. 1, 2017. Gordon said Campbell was later identified as Tory. The transaction allegedly occurred at 18 Summer St., Waterville, and Gordon wrote that Bethea-Lucas, known as “Olivia,” was with him at the time. The affidavit doesn’t specify what “safe zone” property the drug transaction allegedly occurred near.

A similar transaction with a “cooperating defendant” involving 0.50 grams of crack cocaine occurred Nov. 14, 2017, at the same location, Gordon wrote.

Bethea-Lucas is accused of involvement in two separate sales of crack cocaine, one on Kennedy Memorial Drive and the other on Summer Street, both in Waterville. At her hearing, Bethea-Lucas told the judge she uses the last name of Bethea. She was represented by Stephen Bourget, acting as lawyer of the day.

Walker set her bail at $5,000 unsecured, as requested by Coleman, with conditions prohibiting her from use and possession of illegal drugs. Coleman said Bethea had successfully completed a deferred disposition on a 2015 shoplifting charge.

Her next hearing on the new charges is also set for May 17.

On Monday, Coleman requested a condition indicating that Campbell remain in Maine after noting that there was a possible bail hold on Campbell out of New York.

Attorney Lisa Whittier, representing Campbell as lawyer of the day, said she would reserve argument on bail.

Campbell’s next court hearing is set for 2 p.m. May 17, and Walker said bail could be reviewed sooner if Campbell or his attorney requested it.

Winthrop man accused of leading police on second high-speed chase in 2 weeks

AUGUSTA — A Winthrop man is accused of leading police on a high-speed motor vehicle chase through Monmouth and Winthrop Sunday night, allegedly for the second time in just over two weeks.

Roland Pelletier, 62, told a judge Monday that he had recently started drinking again after a decade of sobriety because he got a medical diagnosis indicating he had five years to live.

Pelletier is charged with eluding an officer, criminal operating under the influence, criminal speed, violation of condition of release and operating without a license.

At his initial court appearance at the Capital Judicial Center via video from the Kennebec County jail, Pelletier shook his head in the negative when Judge Eric Walker read the charge of drunken driving.

“I only had two beers,” Pelletier said.

An affidavit by Monmouth Police Officer Dana Wessling says he was in his cruiser watching traffic on U.S. Route 202 at 5:52 p.m. Sunday when an eastbound vehicle passed him at an estimated 90 mph in a posted 55 mph zone.

Wessling said he attempted to catch up to it.

“The vehicle refused to stop, and with my lights and siren activated, the suspect vehicle reached speeds of over 100 mph, passing vehicles and not stopping at stop signs.” Wessling wrote. “The driver did slow down for intersections and curves.”

The 10-mile chase went into Winthrop and back to Monmouth, ending on a dead-end road where Wessling said he arrested Pelletier.

Wessling said a test later showed Pelletier had a 0.10 blood alcohol level.

Wessing’s affidavit referred to a prior incident, saying Pelletier “was chased by the Monmouth and Winthrop Police Department about three weeks ago under almost exact (same) circumstances.”

Court records show that Pelletier was charged with eluding an officer, motor vehicle speeding more than 30 mph over the limit and driving to endanger. In that case, speeds of 110 miles per hour are alleged. The charges are dated March 1, and Pelletier was released on $400 cash bail on March 2.

On Monday, the prosecutor, Assistant District Attorney Christopher Coleman, asked that Pelletier be held without bail on a motion for revocation of bail.

He said Pelletier had a 2015 conviction for eluding an officer and five prior operating under the influence convictions.

Attorney Lisa Whittier, acting as lawyer for the day, said Pelletier’s most recent OUI conviction was from 2004. She asked for $5,000 unsecured bail with conditions.

“Mr. Pelleiter, as far as I know, has a conditional license, which means he can’t drive with any alcohol in his system,” Whittier said. “He has appointments in Boston, Massachusetts, for his medical and psychological problems.”

Pelletier told the judge he was concerned about missing medical appointments if he remained in jail, and that he had “major depression, recurring,” as well as “AFIB (atrial fibrillation), congestive heart failure and chronic bronchitis.”

“You are worrying about your health in the long-term,” Walker said. “I’m more worried about your health in the short-term, and I’m also worried about the safety of anyone else on the road.”

Augusta man convicted of child pornography charges loses appeal before Supreme Court

The Maine Supreme Judicial Court has upheld an Augusta man’s conviction on child pornography charges.

Randy Marquis, now 44, was convicted by a jury in March 2017 of three charges of possession of sexually explicit materials depicting children under 12 — specifically, two separate images and one video — on the computer in his Northern Avenue home.

He had appealed his conviction, saying that a judge should have not permitted the use of statements Marquis made to investigators when they interviewed him at his home or the evidence they obtained when they came to his home on Jan. 16, 2015.

The Maine Supreme Judicial Court, also known as the Law Court, heard oral arguments in the Marquis appeal last month, publishing a decision Tuesday on the court’s website.

At that hearing, attorney Scott Hess, who represented Marquis in the case, argued that Marquis had not given them permission to enter the home.

“Mr. Marquis ‘didn’t invite them in or lead them in,'” Hess told the justices. Chief Justice Leigh Saufley responded that Marquis gave the officers consent to search his computer.

At the same hearing, Associate Justice Thomas Humphrey noted that on an audio recording of the interview, Maine State Police Detective Justin Kittredge told Marquis many times, “I don’t have a warrant. You don’t have to let me do this.”

Assistant District Attorney Frayla Tarpinian, who was also the prosecutor at the trial, maintained that rulings in the case were proper and the conviction on the three charges should stand.

The decision, authored by Maine Supreme Court Associate Justice Donald Alexander, rejects Marquis’ appeal, concluding, “(T)here is sufficient evidence in the record to support a finding that Marquis consented to the officers’ entry.”

Alexander noted that “the investigator gave Marquis a consent-to-search form and told him that by signing the form he was consenting to a search of the computer and the SD card for illegal contraband, specifically child pornography, and that he did not have to give consent. Marquis signed the form, asking for the date.”

Marquis, who did not testify at his trial, was sentenced in April 2017 to an initial six months behind bars, and the remainder of the three-year term was suspended while he spends two years on probation. He is currently on probation.

Pennsylvania man charged with invasion of computer privacy in Farmington

FARMINGTON — Police say a Pennsylvania man is accused of helping a customer at a local dealership buy a car and acquiring the customer’s phone during the transaction.

He proceeded to send nude photos of the customer to himself, according to information posted on Farmington Police Department’s Facebook page.

On Tuesday, Farmington officer Jacob Richards arrested Kevin Rennie, 32, of Philadelphia, on a felony charge of aggravated criminal invasion of computer privacy.

Richards began an investigation after he spoke to a customer of Tinny’s Auto Outlet in Farmington on Monday who worked with Rennie when he helped her with the purchase of a car.

Tinny’s had hired a marketing firm to do a promotional event and Rennie was a subcontracted sales representative for the marketing firm, Deputy Police Chief Shane Cote said. The dealership has severed ties with the marketing firm.

Rennie was issued a no trespassing warning to stay off the property, Police Department secretary Bonnie Pomeroy said Tuesday.

A conviction on the charge is punishable by a maximum five years in prison and a $5,000 fine.

Rennie is being held in lieu of $10,000 cash bail at the Franklin County Detention Center in Farmington. If he does not post bail, he will appear before a judge Wednesday.
