Maine’s high court seeks justification for broad hate-crime order

AUGUSTA — Maine’s high court last week ordered a lower court to explain why potential jail time for any future hate crimes he might commit would be justified for a Turner man convicted of twice ramming into the car of a man he believed was gay.

The Maine Supreme Judicial Court on Tuesday ordered Androscoggin County Superior Court to provide clear reasoning for issuing the “very broad and permanent injunction” against Ronald Champagne.

According to a court order filed in January, authorities say that Champagne yelled a gay slur at a man at a boat launch on Lake Auburn in March 2012. He then told the man he would ram his car into the lake before twice driving into the back of the man’s Subaru.

Last year, Champagne pleaded no contest to reckless conduct with a dangerous weapon and was sentenced to 18 months in prison with all but 14 days suspended, and a year of probation, the Bangor Daily News reported.

The Maine Attorney General’s Office also brought a civil rights case against Champagne under the state’s civil rights act. The office has argued for a court order warning that Champagne could face up to one year in jail if he commits future hate crimes against any group protected under Maine’s hate crimes law.

But Champagne’s attorney, Donald Hornblower, said the court’s order should limit Champagne only from threatening or using violence against individuals because of their sexual orientation.

“I pointed out it was overbroad and there was no evidence supporting” the order, Hornblower said. “A lifetime injunction against all these classes, it’s a very severe thing.”

In the opinion Tuesday, the supreme court justices said that such a comprehensive ban must be based on factual findings and evidence.

“Because the court did not make the required factual findings providing the basis for its injunction, we do not have a sufficient record for appellate review,” the justices said.

The justices said without such details, they can’t decide whether the court abused its discretion.

The Attorney General’s Office didn’t respond to a request for comment Friday.

Ex-nurse avoids conviction in drug theft case

AUGUSTA — A woman who pleaded guilty a year ago to stealing drugs from a Winthrop rehabilitation center withdrew her plea and saw the case dismissed in court Tuesday.

Donna D. Landry, 58, of Smyrna and formerly of Wales, who had been working as a licensed practical nurse at the facility when she was accused of stealing fentanyl, had entered that plea a year ago and was placed on deferred disposition for 12 months with a number of conditions.

Landry fulfilled those conditions — which required her to undergo substance abuse evaluation and do counseling as indicated, refrain from use and possession of illegal drugs, and complete 40 hours of public service work, among other things.

She and her attorney, Allan Lobozzo, were at the Capital Judicial Center Tuesday for the dismissal.

Landry no longer is allowed to work as a nurse. The state Board of Nursing denied a license renewal to Landry in June 2017. It indicates she was first licensed in the state in September 2011.

A notice of denial outlines a number of reasons, including misuse of alcohol or drugs resulting in her performing services in a manner that endangers health of safety of patients, incompetence in nursing, engaging in unprofessional conduct, including diverting drugs, supplies or property of patients or health care providers.

At the hearing in February 2017, a prosecutor said a rescue crew had gone to Heritage Rehabilitation and Living Center in Winthrop on Sept. 2, 2016, because of a report of a worker with a medical problem and found Landry slow to answer questions. She told them she had been taking Tylenol with codeine that she had obtained in Canada.

Once rescuers administered Narcan, she became more responsive, and the next day her husband turned in a fentanyl patch found in Landry’s purse that had a patient’s name on it.

The prosecutor said Landy admitted taking fentanyl patches she had signed out for a patient.

At the earlier hearing, Lobozzo said Landry had been taking codeine and working a number of second and third shifts.

“She doesn’t remember what happened,” he told the judge. “It got signed out, and she was the last person in possession.”

Threat that closed Camden schools was a hoax, police say

CAMDEN — Police say an emailed threat that led to the closure of Camden area schools Wednesday morning was a hoax.

Camden and Rockport Police Chief Randy Gagne said that by midmorning, local, state and federal authorities determined that numerous other schools in Maine along with a school in Florida received the same message.

“At this point we are confident that this incident was a hoax,” Gagne said.

An administrator checking email Wednesday morning saw the threat message shortly after 6 a.m. Superintendent Maria Libby was immediately notified and contacted Camden Police. After a review and discussion, school administration and police decided closing the school was the best option, the chief said. He said closing school allowed police time to research the threat and to conduct searches of the school buildings.

Searches of all school buildings in Camden and Rockport were conducted by officers, firefighters, and custodial staff. Nothing of a suspicious nature was located, he said.

“We will continue to work with our local, state, and federal partners in an attempt to identify where the threat originated from and the identification of the perpetrator,” Gagne said.

There will be no classes on Wednesday, nevertheless. Schools had previously been scheduled to release students early because of the pending snowstorm.

Woman gets 8 days in jail for kicking officer in crotch, asks forgiveness

FARMINGTON — A Jay woman pleaded guilty Tuesday to kicking Jay police officer Dylan Rider in the groin last year when he tried to get her into a cruiser.

Carol Welch, 48, was sentenced to eight days in jail with credit given for four already served. She will report to jail Feb. 20.

Welch entered guilty pleas in Franklin County Superior Court to felony assault on an officer and misdemeanor charges of refusing to submit to arrest or detention-physical force and criminal mischief.

“I am extremely sorry,” she said. “I am an alcoholic. I hope the officer can forgive me for what has happened.”

Rider did not attend the court proceeding.

Deputy District Attorney James Andrews said Rider would have testified that on Oct. 6, 2017, he responded to a domestic dispute complaint and found Welch heavily intoxicated. She complained of back pain and was taken to Franklin Memorial Hospital in Farmington and cleared for release.

Rider would testify that Welch had to be physically removed from the hospital, kicked hospital doors and knocked them off the track and kicked him in the groin after he handcuffed her and tried to get her into a cruiser, Andrews said.

At Tuesday’s sentencing, Judge Rick Lawrence accepted a two-year agreement on the assault charge with conditions that she not use alcohol, continue alcohol abuse counseling and adhere to a pretrial supervision agreement. If she does, she will be allowed to withdraw her plea to the felony charge and it will be dismissed. If she doesn’t, she faces up to five years in prison and a $5,000 fine.

Andrews reviewed Welch’s criminal record, which included convictions for criminal mischief, unauthorized use and operating under the influence, and asked that she be sentenced to 14 days on the misdemeanor charges.

Defense attorney Jeffrey Wilson argued for four days in jail, saying Welch had already been punished by losing her job and being publicly humiliated. She has also checked in with a pretrial supervisor every night, is undergoing counseling and attending Alcoholics Anonymous meetings, he said.

Two central Maine men charged with trafficking in Massachusetts

Two men from central Maine — one from Skowhegan and one from Benton — are being held in a Massachusetts jail in lieu of $50,000 bail each following their arrest on drug charges Sunday morning on Interstate 495 in Haverhill, Massachusetts.

Joshua Blodgett, 26, of Skowhegan, and Shane Lunt, 25, of Benton, were arraigned Tuesday on charges of trafficking in heroin and trafficking in cocaine, according to Trooper Paul Sullivan, a public information officer with the Massachusetts State Police.

The men allegedly possessed 101.1 grams of cocaine and 51.4 grams of heroin, Sullivan said.

Sullivan said Blodgett and Lunt were parked at a rest area in a Chevrolet Malibu, which wasn’t registered to either of them, when two state troopers assigned to the Newbury barracks came upon them about 3 a.m. Sunday. He said both men appeared to be nervous and shaking.

“They observed items that, based on their training experience, were consistent with narcotics use and distribution, including torn-corner baggies, where they stuff the drugs into the corner and tie them off,” Sullivan said by phone.

He said a records check on the men showed previous arrests for drugs, which “threw up a clue to the troopers” that they might be involved in drug trafficking.

Blodgett also was charged with giving a false name to the troopers.

Carrie Kimball Monahan, director of communications at the Essex County District Attorney’s Office in Haverhill, Massachusetts, said both men have been assigned lawyers and are scheduled for a bail review Thursday. In Massachusetts, all defendants have a right to a bail review before a Superior Court judge, she said.

Their next court appearance is scheduled for March 14 in nearby Newburyport, because the Haverhill court is undergoing renovations.

The police report does not contain the street value of the drugs, according to Monahan. She said the penalty for trafficking in cocaine with more than 100 grams and less than 200 grams is eight to 20 years in state prison. For trafficking in heroin with more than 36 grams and less than 100 grams, the penalty is 3.5 to 20 years.

Local and state police continue to arrest people from New Hampshire and Maine who they say go to the Haverhill area to buy drugs and return to their states, where they can sell those drugs for a huge profit, the Newburyport Daily News reported Tuesday in connection with the arrest of Blodgett and Lunt.

Police say drug buyers are drawn to the Lawrence and Haverhill area because of the lower cost of drugs such as heroin, the newspaper reported.

Blodgett was sentenced to eight months in federal prison in July 2013 for his role in a conspiracy to distribute drugs from New York in central Maine.

He pleaded guilty to conspiracy to possess with intent to distribute and distribution of cocaine and oxycodone, as well as possession with intent to distribute oxycodone and aiding and abetting. Three years of supervised release, or federal probation, were to follow the prison term under the sentence imposed by Chief Judge John A. Woodcock Jr. in U.S. District Court in Bangor.

Blodgett had pleaded guilty to the two charges on Feb. 22, 2013, in the same court.

New York man wanted in Maine, New Hampshire over drugs charges

AUGUSTA — A New York man nearing the end of a yearlong sentence at the Maine State Prison in Warren is in demand both in Kennebec County and New Hampshire courts in connection with drug charges.

Anthony Johnson Englesbobb, 31, of Brooklyn, who also had Maine addresses in Augusta and Oakland, was in front of a judge via video Wednesday from the Kennebec County jail for a hearing on charges of unlawful possession of cocaine and violation of conditions of release, both March 22, 2017, in Winslow.

However, it appears that case will take a back seat to a New Hampshire case.

Assistant District Attorney David Spencer told Judge Tom Nale that Maine Department of Corrections officials indicated that New Hampshire has an active warrant for Englesbobb and will send officers to collect him when his Maine sentence concludes early next month.

The charges in the New Hampshire case were not specified, but the Rockingham County (New Hampshire) sheriff’s arrest log, published by Seacoastonline.com, indicates that Englesbobb was arrested May 11, 2016, on a charge of failure to appear for a court conference on an original charge of possession of cocaine.

Spencer said Assistant District Attorney Alisa Ross, who is the prosecutor in the Winslow case, does not want to interfere with the extradition to New Hampshire. She said that Englesbobb could be extradited back to Maine once that charge is resolved.

Nale said he was uncomfortable setting personal recognizance bail because of the lack of information about the handover. He set bail on the Maine case at $5,000 cash and said it would be reviewed as Englesbobb’s release date gets closer.

Englesbobb is serving a one-year sentence for criminal simulation — which involves altering or obscuring the manufacturer’s numbers on a firearm or possessing such a firearm — and illegal possession of a firearm following convictions in York County.

He previously had pleaded guilty to cocaine trafficking in Kennebec County and was sentenced to 18 months in prison in December 2015 just as he was about to go to trial.

Police: NY driver ‘hurrying up to meet a girl for sex’ pulled over in Augusta, faces drug charges

AUGUSTA —A New York man stopped for speeding Tuesday evening in Augusta told the state police officer who stopped him he was rushing to go have sex with a girl on Franklin Street, police said.

Instead, he ended up behind bars on a charge of unlawful trafficking in cocaine and operating without a license.

Deondray T. Warren, 32, was arrested by Trooper Hunter Belanger on Hospital Street. He’s being held in lieu of $25,000 cash bail at the Kennebec County jail in Augusta.

In an affidavit filed with the court, Belanger said Warren initially said he was “hurrying up to meet a girl for sex on Franklin Street in Augusta.”

Belanger also said Warren first said he was traveling from Waterville and then said Waldoboro.

The trooper said he became suspicious when he saw a large amount of cash in Warren’s wallet as Warren searched for a photo identification to support his New York driving permit, and also saw two cellphones in the rental vehicle.

Warren told him he had the cash because he was driving his cousin to Maine, but then said it was from his tax return. When the trooper asked to see the car rental agreement, “Warren called his wife, who stated she took it out of the car.”

Belanger also said Warren claimed his cousin paid him to get the rental vehicle and drive him to Maine.

“Warren stated it was because he needed money and he has met a woman in Augusta who he was going to have sex with, so he would do both on one trip,” Belanger wrote.

Belanger said he frisked Warren and had him stand at the cruiser’s passenger door. When a second trooper arrived, Belanger told Warren he was being arrested on a charge of criminal speed.

An inventory of Warren and his vehicle turned up the two cellphones and $1,488 cash.

As Belanger left the scene to take Warren to jail, Trooper Jacob Roddy called him back.

“On the ground where my passenger side window was located was a plastic sandwich bag containing three vials containing white powder and 12 blue and pink small zip lock bags containing white, rock-like substances,” Belanger wrote, adding that he believed they were crack and cocaine.

At an initial appearance Wednesday at the Capital Judicial Center via video from the Kennebec County jail, Warren was represented by attorney William Baghdoyan, acting lawyer of the day.

Baghdoyan told Judge Tom Nale that the state’s complaint of trafficking against Warren was “fatally defective” for failing to allege 4 or more grams of cocaine.

Nale granted Assistant District Attorney David Spencer’s oral motion to add that to the complaint and set Warren’s bail at $25,000 cash.

Spencer had requested $10,000 cash bail for Warren with a Maine Pretrial Services contract and a condition that Warren remain in Maine.

“The defendant does have a prior record out of New York,” Spencer said, adding that it appeared Warren was awaiting a sentence on a charge of felony possession of a weapon.

He said Warren had been convicted of criminal possession of controlled substances as well.

“The defendant, when stopped, gave various stories about what he was doing and were he was going,” Spencer said.

Baghdoyan suggested lower cash bail along with a Maine Pretrial Services contract. Baghdoyan also said there were issues that can be raised in motions to suppress regarding Warren being detained for a period of time and the search of the car.

Nale said those arguments can be heard later.

FARMINGTON — A Temple man was arrested Tuesday after police responded to a call for assistance from Franklin Memorial Hospital.

William L. Griffin, 38, of Temple, was arrested after Sgt. Michael C. Adcock went to the hospital.

Adcock found Griffin to be uncooperative and discovered he had an outstanding warrant for failure to appear at Waterville District Court on a charge of violation of privacy.

Griffin was arrested, taken to the Franklin County Jail, and later transferred to the Kennebec County jail.

Augusta convenience store robber imprisoned for four years

AUGUSTA — For robbing the Augusta Kwik Mart on Western Avenue last Thanksgiving, Anthony Manganella will spend four years behind bars.

That sentence is the remainder of a 10-year term suspended while he spends three years on probation.

Manganella, 35, pleaded guilty Thursday at the Capital Judicial Center to a class B robbery charge, which carries a maximum penalty of 10 years of imprisonment.

Maine Supreme Judicial Court Associate Justice Donald Alexander imposed the sentence, which had been recommended jointly by the prosecutor and the defense attorney. Alexander also ordered Manganella to pay $574 restitution for the money he stole during the robbery.

Manganella himself told the judge, “I am sorry for what I’ve done. I wasn’t in my right mind.”

Officers arrested Manganella shortly after 11:40 a.m. robbery on Nov. 23, 2017, identifying him and his vehicle with the assistance of surveillance video from the store and traffic footage as well as cellphone mapping data.

The prosecutor, Assistant District Attorney Frayla Tarpinian, said Manganella told officers he had an addiction problem.

“I went five and a half years without opiates,” Manganella told the judge, saying he had been through rehabilitation at St. Mary’s Health System in Lewiston. “I slipped up. That’s why I’m here today.”

Tarpinian described the robbery scene from the clerk’s view, saying, “A man wearing all black pointed a handgun at him and demanded all the money from the register.”

She said the clerk was “terrified for his life” and handed over the money.

The man fled on foot, and not long afterward, Augusta police Sgt. Christopher Shaw conducted a traffic stop on Managanella’s vehicle, finding that he was waring the same clothing that had been seen on the robber in the store as well as with a black BB gun in the center console of the vehicle. No one was hurt in the robbery.

Conditions of probation prohibit Manganella from having contact with the clerk and require substance abuse counseling.

Alexander refused to impose a ban the use of alcohol or possession and use of marijuana after Manganella’s attorney, Lisa Whittier, argued against those conditions.

“Mr. Manganella has never had a problem with alcohol or marijuana,” she said. “He has used (marijuana) medicinally, and it does calm him down.”

Manganella said, “Your honor, I don’t want to be set up for failure.”

Manganella also told the judge that he had been “chewed on by a dog” and that he “used marijuana to manage my pain and my mental state.”

In that July 2011 incident in Manchester, Manganella was one of three people injured. He was hospitalized with arm injuries, including a broken wrist, after he tried to break up a fight between two dogs.

Manganella also won permission to carry tools normally used in his work as a mechanic.

However, Alexander rejected Manganella’s request for a stay in the prison sentence.

Manganella had asked to be allowed to return to owners seven vehicles left at his auto repair shop, put his tools in storage and say goodbye to his children.

“I just don’t think it would be appropriate to authorize a stay in this matter,” Alexander said, suggesting that Whittier might be able to arrange for assistance with some of the issues.
