Norridgewock man who threatened ‘suicide by cop’ found not guilty on felony gun charges

A Norridgewock man indicted on felony charges related to what officials called a “very scary” armed standoff with police in December has been found not guilty by a jury in Somerset County.

Donald L. Bessey, 67, of Smithfield Road, allegedly said he would commit suicide by cop and reportedly threatened people with a loaded handgun at the Norridgewock Cumberland Farms convenience store. He was charged by a grand jury in March with two counts of criminal threatening with a dangerous weapon, both Class C felonies punishable by up to five years in prison on each count.

But following a two-day trial last week, a jury found Bessey not guilty of those charges.

Bessey’s lawyer, Jacqueline Gomes of Westbrook, said Thursday the jury was convinced of Bessey’s innocence after viewing store video taken at the scene where Bessey was arrested and after listening to the audio recording of his 911 call to police. Gomes said Bessey did not threaten witnesses, but did have a gun in his pocket.

Ultimately, the state did not have the evidence to back up the criminal charges, Gomes said.

“This was about Mr. Bessey who was in a bad place mentally,” Gomes said by phone Thursday afternoon. “He was literally trying to commit suicide by cop, but he did everything he could to protect the people around him and the evidence showed that. He was lucky he wasn’t actually shot and was able to get some more help after this incident happened.”

Maeghan Maloney, district attorney for Somerset and Kennebec counties, said Thursday that she did not agree with the verdict.

“I am grateful to the jury for their time and attention,” Maloney said in an email to the Morning Sentinel. “While I disagree with the verdict, I hope Mr. Bessey will take this opportunity to do something kind and positive for his community. He terrified people with his actions. I hope he will now take steps to repair the past through doing something good.”

The Somerset County Sheriff’s Office in December described the standoff as a “very scary situation” and one of the more intense such incidents authorities had encountered.

The incident began just after 8 p.m. when Bessey allegedly called police dispatch and said that he wanted police to come to his house, and when they arrived, he was going to shoot them and he wanted law enforcement to then kill him, the Sheriff’s Office said at the time. When a dispatcher called back, a woman who was a family member said Bessey had been drinking and was outside the home with a handgun.

Gomes said video and audio evidence presented at trial showed that Bessey did not display a weapon inside the store and actually told witnesses to leave the store so they wouldn’t get hurt and that he would not shoot them. She acknowledged that Bessey had been drinking, but was not “a sloppy, falling down drunk.”

Gomes said the jury was out only about an hour before returning with the not guilty verdict.

County deputies, Maine State Police and Fairfield police officers went to the area and set up a perimeter that night. Meanwhile, a state police negotiator got Bessey on the phone at his home and they started talking, but Bessey did not cooperate and ultimately hung up.

Bessey then allegedly left his home and headed to downtown Norridgewock, where a 911 call was placed from the Cumberland Farms store and where a man — later identified as Bessey — had entered the store with a gun and was ordering customers out, saying police were looking for him.

Bessey also grabbed a bottle of liquor and started drinking it, police said. Bessey, armed with a loaded handgun, refused police commands to drop his gun and continued to threaten to kill the officers either by shooting them or running them over in his truck, police said.

Police cordoned off the store area, near the intersection of U.S. Route 2 and Route 139, and started evacuating some nearby homes.

As the state police troopers talked to Bessey, he started to walk around his truck toward police, and Cpl. Gene Cole of the Somerset County Sheriff’s Office saw a chance to get behind Bessey by using the vehicle as cover. Cole deployed his Taser stun gun on Bessey, subduing the man and ending the armed standoff, police said.

The whole incident was over in 10 or 15 minutes, police said at the time.

“I told him in the beginning that I didn’t think the state had the evidence to prove the case,” Gomes said. “I think the fact that I spent hours with the audio and video and tracked the timing of when things actually happened made sense to the jury.”

Man wearing mask, haz-mat suit tries to rob armored car in Camden

CAMDEN –– A man wearing what appeared to be a haz-mat suit and a mask tried to rob an armored truck outside a supermarket Monday morning.

Camden Police Detective Curt Andrick said the incident occurred at about 9 a.m., when the man, wearing a black mask over his face and a bright yellow outfit that looked like a hazardous material suit approached a Brink’s armored truck outside a Hannaford store and tried to open the rear door.

The door was locked and the man, who did not display a weapon, fled on foot to the rear of the shopping center on Route 1.

Andrick said police have been assigned to locations around the area and a police canine from the Belfast Police Department was being deployed to help track the man.

Westbrook woman’s death ruled a suicide

The death of a 50-year-old Westbrook woman who was found shot in her home Monday was a suicide, according to the state Medical Examiner’s Office.

Around 9 p.m. Monday, police were called to a home at 40 Falmouth St., where Norma Bridges was found dead, according to state police.

An autopsy was conducted Tuesday morning, according to Stephen McCausland, spokesman for the Maine Department of Public Safety.

McCausland said the gun has been recovered.

No further details about the case were disclosed.

Parents of slain Augusta man drop appeal to have victims’ fund pay funeral costs

AUGUSTA — A couple who lost their son in an execution-style killing on Christmas morning in 2015 is no longer asking a court to overturn a decision by the state’s Victims’ Compensation Fund, which refused to pay for funeral and counseling costs.

Jeffrey and Susan Williams signed a stipulation of dismissal on Friday, as did Assistant Attorney General Thomas Knowlton, according to court documents.

The Williamses did not return a phone message left Wednesday seeking comment on the dismissal.

A hearing in the appeal had been scheduled for Wednesday at the Capital Judicial Center but was not held because of the appeal being dismissed.

Eric Williams’ parents had sought $4,936 from the state Victims’ Compensation Program for the funeral and burial costs, plus funds for counseling for themselves and their older son.

The board denied the application, saying the law prevents them from paying for those things because Williams committed criminal conduct — authorities say he had burglarized an apartment hours earlier — that led to his death.

State law says, “Compensation may not be paid … to or on behalf of any person who violated a criminal law that caused or contributed to the injury or death for which compensation is sought.”

Williams’ parents had said in their application that “our son is not here to defend himself, nor put (in) his timeline of events of what happened that night according to him.”

The apartment belonged to David W. Marble Jr., also known as “Dee Money,” the man indicted on charges of murdering Eric Williams, 35, and Bonnie Royer, 26, both of Augusta.

Williams was killed just after 3:30 a.m. Dec. 25, 2015, by a single gunshot to the head as he sat in his Chevrolet Trailblazer on Sanford Road in a rural area of Manchester not far from his Augusta home. Royer, in the front passenger seat, was shot in the head and neck. She lived long enough to call 911 on Eric Williams’ cellphone and tell a dispatcher she had been shot.

Marble, now 31, and formerly of Rochester, New York, has pleaded not guilty to two charges of knowing and intentional murder and one of possession of a firearm by a prohibited person, and his case has been transferred to Cumberland County. The next court date is in February 2018.

A 12-page affidavit seeking an arrest warrant for Marble says Williams, two other men and a woman — not Royer — burglarized Marble’s Sewall Street apartment between 12:30 and 1:15 a.m. Dec. 25, 2015, stealing televisions, backpacks, a gun and drugs. It says they did so after learning that Marble was being driven to Westbrook, meaning the drug or “stash” house would be unoccupied.

One man interviewed by police said Williams had a key to Marble’s apartment; however, another man told police one of the burglars entered the apartment by climbing in a window and opening the door for the others.

Other people, including an unnamed informant, told police that Williams had been working for Marble. They said Williams, nicknamed “Chunkie,” was to collect Marble’s money from another drug dealer nicknamed “2Tall” on Dec. 23, 2015, but failed to return with the money to Marble’s apartment.

In their appeal filings in the courthouse in Augusta, the Williamses, who represented themselves, noted that Royer’s funeral costs were approved by the Victims’ Compensation Board.

“She was a foot soldier in trafficking drugs for known drug dealers in the area as well as communicating with Marble the night of this horrible incident,” the Williamses said, referring the 26-year-old Royer. “So why did he murder both, did he also suspect Bonnie because of the phone calls that night or was there another reason?”

They say, “We as a family feel the need to speak on behalf of our son.”

In support of the board’s actions, Knowlton wrote, “In early 2017, the Board received additional information from law enforcement regarding the circumstances surrounding Eric’s murder.” The Board then voted unanimously to deny the application.

Debra Rice, director of the state Victims’ Compensation Program, said previously that only two other claimants appealed denials to the superior court over the past 20 years.

“We have received just shy of 5,000 cases over the life of the Victims’ Compensation Program,” she said in an email in late July. “That averages about 215 cases per year. For the last state Fiscal Year, 25 cases were denied, of which eight were denied for criminal conduct.”
